Nightbird's Mark Mod evasion bug

Nightbird's mark (NBM) says it has 'Evade 1' "evades incoming melee attacks' with a 4% chance.
The problem is that NBM is also causing ranged attacked to be evaded.
I just fought against a mixmaster who has no inherent evasion, yet some of my basic ranged attacks were missing and the word 'evade ranged' appeared on the screen.
Also, it seems to be triggering far more than 4% of the time.

Btw it just says evade attacks doesn't say melee on lower part but upper does so who knows
It should trigger not with so much health or am I wrong about that?
Two times! Started a fight. Opponent hit a 5k jab. Knockout. FIVE K! Next fight (opponent still complete healthy) ... first jab from him... again.. 5k and KNOCKOUT.
Is that the new god mode mod we get offered for energon in a week?
